§ 12-291. Payment of penalties without prosecution.
(a)
Any person who violates the following sections of the Wilmette Park District Code, heretofore adopted by reference by the village: sections 2.05, 2.06, 2.08, 2.10, 2.26, 2.30, 2.31, 4.01, 4.02, 4.04 and 4.06, shall be guilty of an ordinance violation, punishable by a fine of not less than $10.00 if paid within ten days after the date of said violation notice, and not less than $20.00 if paid more than ten days after the date of said violation notice. Any violator may avoid prosecution for violating any of said sections by surrendering the citation or other notice of violation and paying $10.00 to the Police Department within ten days from the date appearing on said violation notice; or $20.00 if paid more than ten days from the date of said violation notice, before legal action has been brought against the violator. Any person making such payment shall receive a receipt therefor from the Police Department.
(b)
Any person who violates sections 2.09 and 2.19 of the Wilmette Park District Code, heretofore adopted by reference by the village, shall be guilty of an ordinance violation, punishable by a fine of not less than $25.00 if paid within ten days after the date of said violation notice, and not less than $35.00 if paid more than ten days after the date of said violation notice. Any violator may avoid prosecution for violating any of said sections by surrendering the citation or other notice of violation and paying $50.00 to the Police Department within ten days from the date appearing on said violation notice; or $70.00 if not paid within ten days from the date of said violation notice, before legal action has been brought against the violator. Any person making such payment shall receive a receipt therefor from the Police Department.
(c)
Any person who violates section 2.03 of the Wilmette Park District Code, heretofore adopted by reference by the village, shall be guilty of an ordinance violation, punishable by a fine of not less than $50.00 if paid within ten days after the date of said violation notice, and not less than $60.00 if paid more than ten days after the date of said violation notice, except in the case of a violation of said section 2.03 based upon a person's permitting a dog to be off-leash and outside of a designated area in which dogs are permitted, in which case the fine shall be not less than $75.00 if paid within ten days after the date of said violation notice, and not less than $85.00 if paid more than ten days after the date of said violation notice. Any violator may avoid prosecution for violating said section by surrendering the citation or other notice of violation and paying $50.00 to the Police Department within ten days from the date appearing on said violation notice, or $60.00 if not paid within ten days from the date of said violation notice, before legal action has been brought against the violator, or in the case of a violation of said section 2.03 based upon a person's permitting a dog to be off-leash and outside of a designated area in which dogs are permitted, by paying to the Police Department $75.00 within ten days after the date of said violation notice, or $85.00 if paid more than ten days after the date of said violation notice, before legal action has been brought against the violator. Any person making such payment shall receive a receipt therefor from the Police Department.
