§ 12-579. Air pollution; nuisance.

  • (a)

    It is unlawful for any person to cause or permit the emission of air pollution, dense smoke or fumes from any source, including, but not limited to, any fire, chimney, engine, or oil burner so as to cause annoyance or discomfort to any individuals.

    (b)

    The owner, proprietor, lessee or occupant of any building, or the person in charge of the furnace therein, who causes, permits or allows the emission of air pollution, dense smoke or fumes from the smokestack of any stationary furnace, or the chimney or smokestack of any building in the village, contrary to the provisions of this Code is guilty of creating a nuisance.
