§ 16-117. Penalty.

  • (a)

    Any person, firm or corporation convicted of a violation of this article shall be guilty of an ordinance violation, punishable by a as provided for in section 2-1305.

    (b)

    Any person who violates any of the provisions of section 16-115, may avoid prosecution for violating any of said section 16-115 by surrendering the citation or other notice of violation and paying to the Police Department within ten days from the date appearing on said violation notice, the sum of $75.00 for a first offense, and $150.00 for a second or subsequent offense within one year. Any person making such payment shall receive a receipt therefor from the Police Department.

    (c)

    In addition to the fine provided for in this section, the violation of section 16-116, Motor Vehicle Alarm, is deemed to be a nuisance which requires immediate abatement, and the village shall be lawfully empowered to abate the nuisance by having the offending vehicle towed, and the owner of said vehicle shall be responsible to the village for its expenses incurred in abating the nuisance, including the cost of towing and storage of the offending vehicle.
