§ 1-2. Definitions and rules of construction.
In the interpretation and construction of this Code, the following definitions and rules of construction shall be observed, unless they are inconsistent with the manifest intent of the Board of Trustees or the context clearly requires otherwise:
Action. The term "action" means any judicial or quasi judicial proceedings.
Board. The term "Board" means the President and Board of Trustees of the Village of Wilmette, Illinois.
Computation of time. The time within which any act provided by law is to be done shall be computed by excluding the first day and including the last, unless the last day is a Sunday or a legal holiday, and then it shall also be excluded. If the day succeeding such Sunday or holiday is also a holiday or a Sunday, then such succeeding day shall also be excluded.
Corporate authorities. The term "corporate authorities" means the President and Board of Trustees.
County. The term "county" means Cook County in the State of Illinois.
Court. The term "court" means any court of record.
Fiscal year. The term "fiscal year" means the period from January 1 of each calendar year through and including December 31 of the same calendar year.
Gender. Words importing the masculine gender include the feminine and neuter.
In the village. The term "in the village" or "within the village" includes all territory over which the village now has or shall hereafter acquire jurisdiction for the exercise of its police powers or other regulatory powers.
Law. The term "law" means the United States Constitution, all applicable federal law, the Constitution and statutes of the State of Illinois, the ordinances of the village, and, when appropriate, any and all rules and regulations which may be promulgated thereunder.
May. The term "may" is permissive.
Month. The term "month" means a calendar month.
Must and shall. The terms "must" and "shall" are each mandatory.
Number. Words importing the singular number may extend and be applied to several persons or things and words importing the plural may include the singular.
Oath. The term "oath" shall be deemed to include an affirmation and the term "sworn" shall be construed to include the term "affirmed."
Or, and. The term "or" may be read "and," and the term "and" may be read "or" if the sense requires it.
Ordinance violation. The term "ordinance violation" means a quasi-criminal violation of the Code whereby a jail or prison sentence is not a penalty.
Owner. The term "owner," as applied to a building or land, includes any part owner, joint owner, tenant in common, joint tenant, tenant by the entirety, of the whole or a part of such building or land.
Person. The term "person" means any individual, partnership, corporation, joint stock association or any city or state or any subdivision thereof; and includes any trustee, receiver, assignee or personal representative thereof.
Personal property. The term "personal property" means and includes every species of property, except real property.
President. The term "President" means the President of the village.
Property. The term "property" means and includes real and personal property.
Published agenda. The term "published agenda" means the agenda of each regular and special meeting of the Board of Trustees as prepared by the Village Manager, published and posted in accordance with the Illinois Open Meetings Act.
Real property. The term "real property" means and includes lands, tenements and hereditaments and embraces all chattels real.
Seal. The term "seal" means the seal of the village.
State. The term "state" means the State of Illinois.
Street. The term "street" includes all streets, highways, avenues, lanes, alleys, courts, places, squares, curbs, or other public ways in this village which have been or may hereafter be dedicated and open to public use, or such other public property so designated in any law of this State.
Tenant and occupant. The terms "tenant" and "occupant," applied to a building or land, include any person who occupies the whole or a part of such building or land, whether alone or with others.
Tense. Words in the present tense include the future.
Time. Central Standard Time shall be the official time within the village, except that in each year official time for the village shall be advanced one hour to Central Daylight Time and thereafter retarded one hour to Central Standard Time, each of the forgoing adjustments to occur on such dates and in such manner as shall be provided for in applicable federal law, more particularly Title 15, United States Code, section 260a (15 USC 260a), now or hereafter amended. All legal or official proceedings of the President and Board of Trustees of the village shall be regulated as to time in accordance with the provisions of this section. When reference is made to any time without qualification in any ordinance, resolution or order heretofore passed or which may be passed hereafter by the President and Board of Trustees of the village or in any official notice, advertisement or document of the village or in any contract to which the village is a party, it shall be understood to refer to the official time of the village as herein prescribed. When the words "Daylight Time," "Daylight Saving" or "Daylight Saving Time" are used in any official publication, document or contract, they shall be understood to have reference to the time fixed for same by applicable federal law.
Village. The term "village" means the Village of Wilmette, in Cook County, State of Illinois, except as otherwise provided.
Written, in writing. The terms "written" or "in writing" may include printing and any other mode of representing words and letters, but when the written signature of any person is required by law to any official or public writing or bond required by law, it shall be in the proper handwriting of such person, or in case he is unable to write, by his proper mark.
Year. The term "year" means a calendar year unless otherwise expressed.
