§ 1-33. Prepayment of penalties; increase in fine for late payment.
(a)
Wherever in section 2-1305 there is a provision for a fine or money penalty and prepayment of such penalty is expressly permitted, prepayment shall be allowed prior to the hearing date provided or the expiration period for which a hearing date may be requested. If no prepayment is provided prior to such a hearing date or a hearing requested as the case may be, there shall be is also an increase in the fine for late payment. Late penalties may be waived by the Corporation Counsel and the Village's Hearing Officer or a judge of the Circuit Court at the request of the violator and only upon a showing of good cause by the violator. In the event that the late payment is not made, collection of said ordinance violation penalties shall be referred to a private collection agency by contract. All prepayment options shall be provided solely for in section 2-1305 and any contradictory provision provided for in another section of this Code shall not apply.
(b)
In the case of transfer of citations to a private collection agency, the following fine schedule shall apply:
(1)
For a citation where the prepayment fine is less than $50.00, the minimum fine shall increase to $50.00 when transferred to a collection agency.
(2)
For a citation where the prepayment fine is $50.00 or greater, but less than $100.00, the minimum fine shall increase to $100.00 when transferred to a collection agency.
(3)
For a citation where the prepayment fine is $100.00 or greater, the minimum fine shall increase to $200.00 when transferred to a collection agency.
(4)
The collection agency's fees shall be added to the unpaid amounts and shall be collected by the collection agency.
