§ 20-123. Applications and fees.

  • (a)

    Applications for driveway permits shall be made to the Village Engineer as provided in section 20-2. Applications shall state the size and location of the driveway, describe the material to be used in the driveway, and provide such other information as the Village Engineer may require. It is unlawful for any person to depart from the specifications or vary from them without the permission of the Village Engineer, in consultation, where applicable, with the Site Plan Review Committee.

    (b)

    The Village Engineer may require an applicant for a driveway permit that proposes the use of driveway material other than concrete or asphalt to execute a waiver of responsibility in favor of the village, in a form to be provided by the Village Engineer, providing that the village shall not be responsible for replacement of non-standard driveway materials, and that any costs associated with replacement of material other than concrete or asphalt caused by maintenance, construction or repair of public facilities, improvements or utilities in the public way shall be the sole responsibility of the property owner.
