Chapter 24. REGULATION OF CERTAIN COMMERCIAL AND QUASI-COMMERCIAL ACTIVITIES |
Article I. IN GENERAL |
§ 24-6. Gasoline Service Station License.
(a)
License required. No gasoline service station shall be operated within the village without a valid gasoline service station license issued by the village.
(b)
Annual fee. The annual fee for a gasoline service station license shall be $50.00.
(c)
Storage tanks. Tanks or containers used for the storage of any flammable liquid or gas shall be free from leaks and shall be constructed in accordance with this Code, other village ordinances, and federal and State law and regulations pertaining thereto. Except as permitted by such ordinances and laws, no tank or container for storage of flammable liquids shall be located within any building.
(d)
Accumulation of waste. It shall be unlawful for any operator of a gasoline service station to permit or maintain any accumulation of waste or other material which is combustible so as to create a fire hazard on any premises used as a gasoline service station.
(e)
Inspection. The Fire Chief shall make regular inspections of gasoline service stations to ensure that they are being operated in accordance with this Code, any other ordinance of the village, and the federal and state law pertaining thereto.
(f)
Reinspection and fee. If the Fire Chief, during the course of a regular inspection, finds that a gasoline service station is not operating in accordance with this Code, other village ordinances, or federal or State law pertaining thereto, the Fire Chief may allow the gasoline service station to continue to operate, provided that the gasoline service station shall be required to correct the unlawful condition by a specified date, and provided that the conduct of the business or activity pending the correction of the condition will not endanger the public health, safety or welfare. The Fire Chief shall reinspect the gasoline service station to verify that the condition has been corrected by the specified date. If the Fire Chief is required to make more than one reinspection before the gasoline service station corrects the condition, the gasoline service station shall be required to pay a reinspection fee of $100.00 for each reinspection after the first reinspection.
