§ 24-33. Outdoor Restaurant Seating and Cooking License.

  • (a)

    No person or entity shall operate a business licensed as a food handler as provided in section 24-5, which provides outdoor seating for the purpose of serving food or beverages to customers, or provides for the outdoor cooking, through the use of a grill, rotisserie or other heat source, of food, without a valid license as provided in this section. Said license shall be in addition to any other license required by this article, including a Food Handler License.

    (b)

    A person or entity lawfully operating a restaurant with outdoor seating pursuant to a special use or variation adopted by ordinance by the village prior to July 1, 1995, shall be bound by the terms of that ordinance and shall not be required to obtain a license under this section.
