Chapter 24. REGULATION OF CERTAIN COMMERCIAL AND QUASI-COMMERCIAL ACTIVITIES |
Article IV. TOBACCO DEALERS |
§ 24-100. Unlawful sale or delivery; sale in unlawful quantities; signs; self-service displays unlawful.
(a)
It shall be unlawful for any person, including any licensee, to sell, offer for sale, give away or deliver tobacco products or tobacco paper to any person under the age of 21 years.
(b)
It shall be unlawful for any licensee to allow, engage, or permit any person under the age of 21 years to sell, offer for sale, give away or deliver any tobacco products or tobacco paper.
(c)
It shall be unlawful for any licensee to sell or offer for sale tobacco products through the use of a tobacco vending machine.
(d)
It shall be unlawful for any licensee to sell, offer for sale, give away or deliver individual cigarettes or cigarettes packaged in a quantity of less than 20 cigarettes.
(e)
It shall be unlawful for any licensee to sell, offer for sale, give away or deliver any tobacco products in any manner which violates any law, administrative rule or regulation of the State or the United States.
(f)
A licensee shall be required to post, at or near every place in the licensed premises where tobacco products are sold or offered for sale, a plainly visible sign which shall state in characters no less than one inch high; "THE SALE OF TOBACCO PRODUCTS TO PERSONS UNDER 21 YEARS OF AGE IS PROHIBITED BY LAW," provided that the posting of a substantially similar sign as that provided herein which is required by state or federal law or regulation shall be deemed to constitute compliance with this section.
(g)
No self-service tobacco products. It shall be unlawful for any licensee to sell, offer for sale, or display for sale any tobacco products or tobacco paper not kept behind a service counter or otherwise kept so that customers may not obtain any tobacco products without the assistance of an employee of the licensee. Self-service display for the sale of tobacco products when said products are displayed for sale enclosed in a fixed, free-standing, walk-in humidor for storing tobacco products in which the air is kept properly humidified and which is of not less than 100 square feet in area shall not constitute a violation of this section.
