§ 8-1. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Basement means a portion of a building located partly underground, but having less than half its clear floor-to-ceiling height below the average grade of the adjoining ground.

    Building means anything constructed for the shelter of persons, animals, chattels, or movable property of any kind, and which is permanently affixed to the land.

    Cellar means a portion of a building located partly or wholly underground and having half or more than half of its clear floor-to-ceiling heights below the average grade of the adjoining ground.

    Dwelling means any building which is wholly or partly used or intended to be used for living or sleeping by human occupants.

    Dwelling unit means a room or group of rooms used or intended to be used as a housekeeping unit for living, sleeping, cooking and eating.

    Extermination means the control and elimination of insects, rodents, or other pests by eliminating their harboring places; by removing or making inaccessible materials that may serve as their food; by poisoning, spraying, fumigation, trapping; or by any other recognized and legal pest elimination methods approved by the Director of Community Development.

    Family means either:

    (1)

    One or more persons, each related by blood, marriage or legal adoption (including foster children), living as a single housekeeping unit in a dwelling unit, together with no more than two live-in staff or boarders; or

    (2)

    Not more than three persons, not related by blood, marriage or legal adoption, (including foster children), living as a single housekeeping unit, together with no more than two live-in staff.

    For the purposes of this definition, the term "living as a single housekeeping unit" means that each person has the equal right to use, in common with the others, the areas customarily considered to be common areas in a dwelling unit.

    Garbage means organic kitchen waste, paper, and food wrappings.

    Habitable room means a room or enclosed floor space used or intended to be used for living, sleeping, cooking or eating purposes, excluding bathroom, water closets, laundries, pantries, foyers or communicating corridors, closet storage spaces.

    Occupant means any person, over one year of age, living, sleeping, cooking or eating in, or having actual possession of a dwelling unit or rooming unit, provided, however, that any child over one year and under 12 years of age shall be counted as one-half person, for the purpose of this chapter.

    Operator means any person who has charge, care or control of a building, or part thereof, in which dwelling units or rooming units are let.

    Owner means any person or group of persons who shall have legal or equitable title to a dwelling unit, the agent of said person, or any person having management or control of any dwelling unit; provided, however, that no person acting as managing agent or collector of rents of any property involved in any proceeding hereunder shall be liable hereunder if such person within five days after receipt of notice of any alleged violation or of summons shall have notified in writing by registered United States mail, or personal service, the owner or owners of the property or the employer of such person of the purported violation or violations of any provision or provisions of this housing code and shall have delivered to the Director of Community Development of the village a copy of the notice with proof of service thereof on the owner or employer.

    Rooming unit means any room or group of rooms forming a single habitable unit used or intended to be used for living and sleeping; but not for cooking or eating purposes.

    Rubbish means combustible and noncombustible waste materials, except garbage, and the term shall include the residue from the burning of wood, coal, coke and other combustible material; paper, rags, cartons, boxes, wood, excelsior, rubber, leather, tree branches, yard trimmings, tin cans, metals, mineral matter, glass, crockery, and dust.
