§ 8-4. Local amendments to property maintenance code.

  • The following additions, insertions, deletions and changes are made to the International Property Maintenance Code, 2006 Edition, so that said sections shall hereafter read as follows:

    (1)

    Section 101.1 Title. Village of Wilmette.

    (2)

    Section 103.5 Fees. 2016 Village Fee Schedule.

    (3)

    Section 111, Means of Appeal, is replaced its entirety so that the same shall read as follows: Section 111 Means of Appeal. Appeals shall be heard pursuant to Section 9-3.1(e) of the Village Code.

    (4)

    Section 202 General Definitions. The new definitions below shall be added in alphabetical order, the existing definitions noted below shall be modified so that the definition showing in this local amendment shall wholly replace the definition shown in the published Property Maintenance Code. All other definitions are in full force and effect:

    BASEMENT. That Portion of a building which is partly or completely below grade, but having less than half its clear floor-to-ceiling height below the average grade the adjoining ground.

    BUILDING. Anything constructed for the shelter of persons, animals, chattels, or movable property of any kind, and which is permanently affixed to the land.

    CELLAR. A portion of the building located partly or wholly underground and having half or more than half of its clear floor-to-ceiling heights below the average grade of the adjoining ground.

    DWELLING. Any building which is wholly or partly used or intended to be used for living or sleeping by human occupants.

    EXTERMINATION. The control and elimination of insects, rats rodents or other pests by eliminating their harborage places; by removing or making inaccessible materials that may serve as their food; by poisoning, spraying, fumigating, trapping or by any other recognized and legal pest elimination methods approved by the Director of Community Development.

    OCCUPANT. Any person, over one year of age, living, sleeping, cooking or eating in, or having actual possession of a dwelling unit or rooming unit, provided, however, that any child over one year and under twelve years of age shall be counted as one-half person, for the purpose of this chapter.

    Section 304.14, Insect Screens. Insert DATES IN TWO LOCATIONS April 1 and November 1.

    Section 602.3 is replaced its entirety so that the same shall read as follows:

    602.3. Heat supply. Every dwelling unit or rooming unit to which heat is furnished from a heating plant used in common for the purpose of heating the building shall be supplied with heat, without such undue restriction of ventilation as to interfere with proper sanitary conditions, to provide a minimum temperature of 65 degrees Fahrenheit at 6:30 a.m. and 70 degrees at 8:30 a.m. and thereafter until 10:30 p.m. and a minimum temperature of 60 degrees Fahrenheit thereafter until 6:30 a.m. average through the dwelling unit or rooming unit. All temperature readings shall be made only by the Director of Community Development, or some person duly authorized by him, and shall be taken by means of a standard Fahrenheit thermometer at one or more points within any habitable room not less than four feet nor more than six feet above the floor of such room and at least four feet away from any door or window leading to the outer air.
