Article IX. TREE REMOVAL PERMITS |
§ 8-350. Violations and penalties.
(a)
It shall be an offense for any person to remove a tree without having first obtained a tree permit, if so required under the provisions of this article. It shall be an offense for a property owner to employ, authorize or direct any third person or entity to remove a tree without having first obtained a Tree Permit, if so required under the provisions of this article.
(b)
It shall be an offense for any person or entity to remove any ash tree (Fraxinus sp.) including any genus, species, varieties and cultivars thereof, without such person or entity having first entered into, or being covered by, a Compliance Agreement with the Illinois Department of Agriculture governing the removal and disposal of ash trees in the Emerald Ash Borer quarantine zone.
(c)
A separate offense shall be deemed to have been committed for each tree removed without a Tree Removal Permit in violation of the provisions of this article.
(d)
Each offense under this article shall be punishable by a fine in the amount of not less than $250.00 and not more than $1,500.00 for each offense.
