§ 8-379. Protection of public property.

  • (a)

    Permittees shall not damage public property or the public right-of-way. Prior to the removal of a portable storage container from public property or public right-of-way, the permittee shall notify the Department of Engineering and Public Works. Upon discovery of any damage, the Village Engineer shall notify the permittee and the property owner of the total cost to repair the damaged public property. The portable storage owner and property owner shall not be able to obtain future village permits until:

    (1)

    The permittee or property owner repair or restore the damaged area to a condition acceptable to the Director of Engineering and Public Works; or

    (2)

    The Director of Engineering and Public Works repairs or has repaired the damage and the permittee or property owner has reimbursed the village; or

    (3)

    The Director of Engineering and Public Works gives written authorization, based upon the specific circumstances, that a second or subsequent dumpster is needed to promote the health, safety, and welfare of the public.

    (b)

    Failure to comply with the prompt repair to public property shall be a violation of this Code.
