§ 8-633. Enclosure required.

  • Every owner, purchaser under contract, lessee, tenant or licensee of land within the village upon which is situated a private spa or hot tub, shall at all times maintain, on the lot or premises upon which such private spa or hot tub is located, a fence or other structure completely surrounding such spa or hot tub, not less than four feet in height, with no gaps, other than doors or gates, greater than four inches. All gates or doors opening through such fence or enclosure shall be equipped with self-closing and self-latching devices placed at the top of such gates or doors and made inaccessible to small children. Such devices shall be so designed as to be capable of keeping such doors and gates securely closed at all times when the spa or hot tub is not in actual use; provided, however, that the door of any dwelling forming a part of the enclosure need not be so equipped. Spas or hot tubs which are placed at grade level and are higher than 48 inches above grade and do not have any adjacent stairs for access, need not have the above specified enclosures.
