Article XXIX. APPENDIX 9A DEVELOPMENT REGULATIONS IN FLOOD HAZARD AREAS |
§ 8-943. 400.0 How to use this appendix.
(a)
401.0 The Village Engineer shall be responsible for fulfilling all of the duties listed in section 8-944.
(b)
402.0 To fulfill those duties, the Village Engineer first should use the criteria listed in section 8-945, Base Flood Elevations, to determine whether the development site is located within a floodplain.
(c)
403.0 Once it has been determined that a site is located within a floodplain, the Village Engineer must determine whether the development site is within a flood fringe, a designated floodway, or within a SFHA or floodplain for which no floodway has been identified.
(d)
403.1 If the site is within a flood fringe, the Village Engineer shall require that the minimum requirements of section 8-946 are met.
(e)
403.2 If the site is within a floodway, the Village Engineer shall require that the minimum requirements of section 8-947 are met.
(f)
403.3 If the site is located within a SFHA or floodplain for which no detailed study has been completed and approved, the Village Engineer shall require that the minimum requirements of section 8-948 are met.
(g)
404.0 In addition, the general requirements of section 8-926 shall be met for all developments meeting the requirements of section 8-946, 8-947, or 8-948.
(h)
405.0 The Village Engineer shall assure that all subdivision proposals shall meet the requirements of section 8-950.
(i)
406.0 If a variance is to be granted for a proposal, the Village Engineer shall review the requirements of section 8-951 to make sure they are met. In addition, the petitioner shall complete all notification requirements.
(j)
407.0 In order to assure that property owners obtain permits as required in this appendix, the Village Engineer may take any and all actions as outlined in section 8-953.
