§ 10-19. Identification cards.

  • (a)

    If a licensee or the licensee's agent or employee believes or has reason to believe that a sale or delivery of alcoholic liquor is prohibited because of the age of the prospective recipient, the licensee or agent or employee thereof shall, before making such sale or delivery, demand presentation of one of the following forms of positive identification, each containing proof of age and a photograph of the prospective recipient, without which such sale or delivery shall not be permitted:

    (1)

    A motor vehicle operator's license or an identification card issued by the Secretary of State of the State of Illinois; or

    (2)

    A motor vehicle operator's license or identification card issued by another State of the United States of America, or a foreign government;

    (3)

    A passport; or

    (4)

    A military identification card issued to a member of the armed forces of the United States of America.

    (b)

    No person shall transfer, alter or deface such an identification card; use the identification card of another; carry or use a false or forged identification card; or obtain an identification card by means of false information.

    (c)

    Any person who is convicted of a violation of this section shall, for the first offense be fined not less than $100.00 nor more than $250.00, and for a second or subsequent offense shall be fined not less than $250.00 nor more than $750.00.
