  § 20-127. Petitions for reconsideration.

  • (a)

    An applicant for a permit for a driveway proposed to serve a single family residential structure whose application has been denied by the Village Engineer because of its failure to satisfy the standards set forth in section 20-126 may, in lieu of a request for review of such decision by the Municipal Services Committee of the Board of Trustees (MSC) as provided in section 20-130, petition the Village Engineer to reconsider the denial and for relief from the strict application of the standards set forth in section 20-126. Such petition for reconsideration must be made within the same period of time as that permitted for a request for review of the Village Engineer's decision as provided in section 20-130. The petition shall be in writing, shall state the reasons justifying relief from the strict application of the standards set forth in section 20-126, and shall state with particularity why the request satisfies the standards for relief set forth in this section.

    (b)

    An applicant may not both petition the Village Engineer for reconsideration under this section and seek review of the Village Engineer's decision to deny the application for driveway permit under section 20-126. An applicant who petitions the Village Engineer for reconsideration under this section shall not thereafter be permitted to seek review of the Village Engineer's original determination under section 20-130 that the application does not comply with the standards set for in section 20-126. However, an applicant who petitions the Village Engineer for reconsideration under this section, and who is denied such relief, may appeal that denial to the MSC in the manner provided in section 20-130.

    (c)

    An applicant who seeks review by the MSC under section 20-130 of the Village Engineer's original determination under section 20-126 shall be deemed to have waived the privilege of petitioning the Village Engineer for reconsideration of said determination pursuant to this section, and shall not thereafter be permitted to petition the Village Engineer for relief pursuant to this section.

    (d)

    When an application for review is made pursuant to subsection (a) of this section there shall be a fee of $163.00.
