§ 20-126. Standards for review of applications or revocations by the Village Engineer.

  • (a)

    Where an application for a permit for a proposed driveway which has been reviewed and approved by the Site Plan Review Committee pursuant to the provisions of article VIII of chapter 8, a driveway permit shall be issued. Where an application for a driveway permit concerns a proposed driveway to serve a single family residential structure which is not subject to review and approval by the Site Plan Review Committee pursuant to the provisions of article VIII of chapter 8, then a driveway permit shall be issued only if the Village Engineer determines that the applicant has demonstrated that:

    (1)

    There will be only one driveway serving the property and that driveway will provide access to an alley; or

    (2)

    If there is no alley access available, the driveway shall have no more than one curb cut to a public street.

    (3)

    In addition to those provided elsewhere in this Code, the following design standards shall apply to all residential driveways with access to a public street:

    a.

    Driveways for single family residences shall not exceed a width of 18 feet at the property line.

    b.

    Driveways for all non-single family residences shall not exceed a width of 24 feet at the property line.

    c.

    All residential driveways shall have a minimum distance of 50 feet from the edge of the driveway to the nearest parallel curb at an intersection.

    d.

    Circular driveways are permitted only when a lot has a minimum width of 75 feet.

    (b)

    Where alley access exists to the driveway to serve a single family residential structure which is not subject to review and approval by the Site Plan Review Committee, a permit for a front or side yard driveway shall not be issued unless the Village Engineer grants an exception in accord with subsection (c) and (d) of this section.

    (c)

    Authorized exceptions. The following shall be authorized exceptions from the requirements of sections (a) and (b) of this section pursuant to the procedure in subsection (d) of this section:

    (1)

    Retaining an existing front or side yard driveway and building a second driveway with alley access.

    (2)

    A front or side yard driveway accessing a street in lieu of construction of a driveway with access to an available alley.

    (3)

    Two curb cuts to allow installation of a circular driveway.

    (d)

    Exception procedure. Any person seeking an exception to subsections (a) and (b) of this section may apply for an exception in writing to the Village Engineer.

    (1)

    The application shall be accompanied by a written statement in support which sets forth a detailed basis for the exception, demonstrating why the application meets the criteria contained in section 20-129 of this chapter. The applicant shall also submit all documentation which supports the application. The Village Engineer may request any additional documentation which he deems necessary to review the application.

    (2)

    The Village Engineer shall review applications for exceptions and apply the criteria set forth in section 20-129. As part of the review the Village Engineer shall send written notice by first class mail to the occupant of all properties within 250-linear feet of the subject property on both sides of the street in the block where the proposed driveway is to be located. In cases where the subject property has frontage on two public streets, the Village Engineer shall send the notice to all properties located within 250-linear feet of the subject property in any direction.

    (3)

    There shall be a public comment period open for 30 days from the date the notice was placed in the mail (comment period). During the comment period, any member of the public may submit written comments to the Village Engineer regarding the application for the exception. After the close of the comment period, the Village Engineer shall issue a written determination to the applicant granting or denying the request for exception.
