§ 26-184. Lien for unpaid bills.
(a)
Whenever a bill due the village for water service remains unpaid 90 days after it has been rendered, the village may file with the Recorder of Deeds of the County a statement of a lien claim. This statement shall contain the legal description of the premises served, the amount of the unpaid bill plus costs incurred by the village in filing the lien, and a notice that the village claims a lien for this amount as well as for all charges for water served subsequent to the period covered by the bill.
(b)
If the consumer of water whose bill is unpaid is not the owner of the premises and the village has notice of this, notice shall be mailed to the owner of the premises, if his address be known to the village, whenever such bill remains unpaid for a period of 90 days after it has been rendered.
(c)
The failure of the village to record such lien claim or to mail such notice or the failure of the owner to receive such notice shall not affect the right to foreclose a lien for unpaid water bills as mentioned in the following section. The owner shall be responsible for recordation and costs of recording any release of lien or related documents.
