§ 8-177. Exemptions from Grading and Drainage Permits.

  • Projects that, in the determination of the Village Engineer, do not alter an existing grade, contour or drainage flow will not be subject to the permitting requirements herein, including, but not limited to, the following:

    (1)

    Raised decks;

    (2)

    Patios built at grade;

    (3)

    Fences;

    (4)

    Tree removal and planting; and

    (5)

    The maintenance of private lakefront beaches, provided that the following conditions are met:

    a.

    The purpose of the grading is to level existing sand and other beach material and not to excavate or alter the existing character of the beach;

    b.

    The addition or removal of sand dunes shall not be considered "maintenance" for the purposes of this section;

    c.

    Quantities of sand or other beach material shall not be added to or removed from the site;

    d.

    The leveling of sand and other beach material shall not be conducted in a manner that alters, reverses or redirects the natural flow of water; and

    e.

    The site to be graded is not located in a designated floodway which is subject to article XXIX of this chapter.
