§ 14-139. Size, weight and load regulations.

  • (a)

    It shall be unlawful to operate on any street, highway, roadway, alley, and bridge under the jurisdiction of the village, any vehicle or combination of vehicles exceeding the size and weight limitations provided in ILCS ch. 625, act 5, § 15-102 (width), ILCS ch. 625, act 5, § 15-103 (height), ILCS ch. 625, act 5, § 15-107 (length), and ILCS ch. 625, act 5, § 15-111 (weight).

    (b)

    Where lower size and weight limits or other restrictions are imposed by ordinance under authority of ILCS ch. 625, act 5, §§ 15-316 and 5/15-317, and signs indicating such limitations or restrictions are posted, it shall be unlawful to operate any vehicle or combination of vehicles in excess of the adopted size or weight limitations found in this chapter.

    (c)

    Exceptions. The provisions of this chapter governing weight do not apply to the following:

    (1)

    Emergency vehicles;

    (2)

    Vehicles owned and operated by governmental agencies;

    (3)

    Vehicles owned and operated by private utilities;

    (4)

    Buses;

    (5)

    Vehicles engaged in the collection and removal of garbage or refuse;

    (6)

    Snow removal vehicles engaged in snow removal functions on private property or for the village;

    (7)

    Tow trucks;

    (8)

    Vehicles operating under the terms of a valid oversize permit issued by the Illinois Department of Transportation and the village; or only a village permit if an Illinois Department of Transportation permit is not required by the department;

    (9)

    Any other vehicles that meet the criteria for an exception to this chapter pursuant to the Illinois Vehicle Code;

    (10)

    All vehicles shall have access within one road-mile from I-94 that use the most reasonable and practicable route to their destination.

    (d)

    Village streets with designated size and weight limits.

    (1)

    Except as otherwise set forth in this chapter, the maximum size and weight limits set forth by the Illinois Vehicle Code shall apply to all village streets.

    (2)

    Vehicles required to obtain a permit pursuant to this section shall be restricted to operating on collector streets and major streets as defined in sections 14-114(b) and (c), except where otherwise allowed by this chapter or expressly allowed in the route designated in the permit.

    (3)

    No vehicle or combination of vehicles equipped with pneumatic tires shall be operated upon any street or bridge in violation of the following weight limitations:

    a.

    No vehicle or combination of vehicles shall be operated, unladen or with load, upon the bridge located between 128 W. Linden and 200 W. Linden when the gross weight including load on the road surface exceeds ten tons.

    b.

    No vehicle or combination of vehicles shall be operated, unladen or with load, upon the bridge located on 128 W. Maple and 200 W. Maple when the gross weight including load on the road surface exceeds 15 tons.

    c.

    No vehicle or combination of vehicles shall be operated, unladen or with load, upon the bridge located between 590 N. Sheridan and 610 N. Sheridan when the gross weight including load on the road surface exceeds 74,880 pounds.

    (e)

    Posting of signs. Where size and weight limitations are imposed by ordinance that are different from the standards adopted in subsection (a) of this section, the Director of Engineering and Public Works or any other person designated by the Village President and Board of Trustees shall post or cause to be posted suitable signs designating weight limitations established by this chapter.

    (f)

    Violations; penalties (weight).

    (1)

    Fines. Whenever a vehicle or combination of vehicles is operated in violation of the weight restrictions set forth in this chapter; the owner or driver, or both shall be deemed guilty of such violation; and either the owner or driver, or both may be prosecuted for such violation. Any person, firm, or corporation convicted of any violation of the weight restrictions set forth in this chapter shall be fined in an amount equal to the following:

    Up to and including 2,000 pounds overweight The fine is $100.00
    From 2,001 through 2,500 pounds overweight The fine is $270.00
    From 2,501 through 3,000 pounds overweight The fine is $330.00
    From 3,001 through 3,500 pounds overweight The fine is $520.00
    From 3,501 through 4,000 pounds overweight The fine is $600.00
    From 4,001 through 4,500 pounds overweight The fine is $850.00
    From 4,501 through 5,000 pounds overweight The fine is $950.00
    From 5,001 or more pounds overweight The fine shall be computed by assessing $1,500.00 for the first 5,000 pounds overweight and $150.00 for each additional increment of 500 pounds overweight or fraction thereof.

     

    (2)

    Liability if street or structure damaged. Any person driving any vehicle or combination of vehicles upon any street is liable for any and all damages which the street or structure may sustain as a result of any illegal operation.

    (3)

    Any person, firm, business, or corporation that owns and operates the transporting vehicle or that operates the vehicle under a bona fide lease agreement who violates any of the weight restrictions of this section, may avoid prosecution for violating any of this section by surrendering the citation or other notice of violation and paying to the Police Department within ten days from the date appearing on said violation notice, the applicable minimum fine as indicated in subsection (f)(1) of this section. Any person making such payment shall receive a receipt therefor from the Police Department.

    (g)

    Violations; penalties (non-weight violations).

    (1)

    Whenever a vehicle or combination of vehicles is operated in violation of any restrictions set forth in this chapter other than a weight restriction; the owner or driver, or both shall be deemed guilty of such violation; and either the owner or driver, or both may be prosecuted for such violation. Any person, firm, or corporation convicted of any violation of any restrictions set forth in this chapter other than the weight restriction shall be fined in an amount not less than $250.00 and not more than $1,000.00.

    (2)

    Liability if street or structure damaged. Any person driving any vehicle or combination of vehicles upon any street is liable for any and all damages which the street or structure may sustain as a result of any illegal operation.

    (3)

    Any person, firm, business, or corporation that owns and operates the transporting vehicle or that operates the vehicle under a bona fide lease agreement who violates any of the non-weight restrictions of this section, may avoid prosecution for violating any of said this section by surrendering the citation or other notice of violation and paying to the Police Department within ten days from the date appearing on said violation notice, the sum of $250.00. Any person making such payment shall receive a receipt therefor from the Police Department.
