§ 6-130. Contracts authorized by the Board of Trustees.

  • (a)

    All contracts exceeding in amount the sum of $25,000.00 for services, supplies, equipment or any other necessities required by the village, other than motor fuel, shall require the approval of the Village Manager and the Board of Trustees. All contracts for the purchase of motor fuel exceeding in amount the sum of $42,000.00 shall require the approval of the Village Manager and Board of Trustees.

    (b)

    Any such contract shall be awarded to the lowest reliable and responsible bidder after advertising for the same, and bonds may be taken for faithful performance thereof; however, this bid provision shall not apply to contracts for services, supplies or equipment when:

    (1)

    The contract is authorized by a vote of two-thirds of the Board of Trustees; or

    (2)

    The contract is for the services of individuals, possessing a high degree of professional skill where the ability or fitness of the individual plays an important part; or

    (3)

    The contract is for the purchase of supplies, materials, parts or equipment available only from a single source; or

    (4)

    The contract is to be paid in whole or in part by special assessment, which contracts shall be subject to the applicable statutory assessment procedure; or

    (5)

    The contract is to provide the normal utilities to the various village activities; or

    (6)

    The contract is awarded in accordance with the state statutes concerning the expenditure of Motor Fuel Tax Funds; or

    (7)

    The contract is for membership or participation in an intergovernmental organization or entity, which includes the payment of periodic dues or assessments as a condition of membership; or

    (8)

    The contract is for the periodic purchase of motor fuels, provided that the purchase is made:

    a.

    Pursuant to an intergovernmental purchasing contract or similar intergovernmental cooperative purchasing program that has been previously approved by the Board of Trustees; or

    b.

    After obtaining at least three price quotations, and is made from the motor fuel provider who provided the lowest reliable and responsible price quotation.

    (c)

    Unless otherwise required as a condition of receipt of state or federal funding, whenever the village awards a contract for professional services pursuant to subsection (b)(2) of this section, the village shall be entitled, in the exercise of its sole discretion and in such manner as it may determine, to require persons or entities responding to requests for proposals, requests for qualifications, or any other form of solicitation for such services issued by the village, to provide cost information, whether in terms of estimated costs or expenses, hourly rates, fixed or variable costs, hours of work anticipated, percentage of construction costs, or any other measure of the same or similar information as may be determined by the village. The village shall have the right and ability to evaluate proposals or submissions for such professional services in such manner, including negotiating price or cost, as it deems in the public interest. The provisions of this section are an exercise of the village's constitutional home rule authority, shall constitute the total, comprehensive and exclusive regulation of the subject matter covered herein, and shall wholly displace and preempt all provisions of the Local Government Professional Services Selection Act, chapter 50, act 510, section 0.01 et seq. (50 ILCS 510/0.01 et seq.), in effect now or as amended hereafter.
